These Gift Card Terms & Conditions apply to all gift cards issued by The Beach Company. By purchasing, holding or using a gift card, you agree to these terms.
1.1 Gift cards may only be redeemed at participating The Beach Club locations, subject to availability and acceptance at the point of sale.
1.2 Gift cards are valid only for the purchase of eligible goods and services sold directly by us.
1.3 Gift cards remain the property of The Beach Company and may be cancelled, refused or retained where permitted under these terms.
2.1 Gift cards are valid for 12 months from the date of purchase, unless a different expiry date is expressly stated on the gift card.
2.2 The expiry date is printed on the gift card where applicable.
2.3 Once expired, the gift card will no longer be valid and any unused value will be lost.
3.1 The full value of the gift card must be redeemed in a single transaction.
3.2 No change, cash refund, credit note or residual balance will be given where the total bill is less than the value of the gift card.
3.3 If the purchase value exceeds the value of the gift card, the difference must be paid by another accepted payment method.
3.4 Gift cards must be presented at the time of payment. We may refuse redemption where the gift card cannot be validated.
4.1 Gift cards are non-refundable and cannot be exchanged for cash, except where required by law.
4.2 Gift cards may not be returned or refunded after purchase unless they are defective or where the law gives you a right to a refund.
4.3 Gift cards may not be used to purchase another gift card, unless we expressly allow this.
5.1 Gift cards should be treated like cash.
5.2 We are not responsible for lost, stolen, damaged, destroyed or unauthorised use of a gift card.
5.3 Lost or stolen gift cards will not usually be replaced unless we decide to do so at our sole discretion and satisfactory proof of purchase is provided.
5.4 We may refuse to accept any gift card that appears to be defaced, altered, duplicated, damaged, copied, forged or otherwise tampered with.
6.1 Gift cards may only be used for genuine personal or gift purposes and must not be used in connection with any unlawful, fraudulent or improper activity.
6.2 We reserve the right to refuse redemption of a gift card where we reasonably believe:
7.1 We reserve the right to suspend, cancel, reject or void a gift card where we reasonably suspect fraud, theft, tampering, duplication, misuse, attempted misuse, or other unlawful activity.
7.2 We may also refuse to redeem a gift card during any transaction where a customer behaves in a threatening, abusive or aggressive manner towards our staff.
7.3 Any decision to permanently cancel or void a gift card will only be made by management where we reasonably consider it necessary and lawful in the circumstances.
7.4 Where appropriate, we may require an alternative form of payment and/or proof of purchase before accepting a gift card.
8.1 Gift cards may not be resold for profit, used for promotional giveaways without our permission, or transferred as part of any unauthorised commercial arrangement.
8.2 We reserve the right to cancel gift cards that are resold, advertised or used in breach of this clause.
9.1 To the fullest extent permitted by law, we accept no liability for any loss arising from a lost, stolen, damaged or unauthorisedly used gift card.
9.2 Nothing in these terms excludes or limits any liability which cannot lawfully be excluded or limited.
10.1 We may update these Gift Card Terms & Conditions from time to time where necessary for legal, regulatory, security or operational reasons.
10.2 The current version will be published on our website and/or made available on request.
10.3 Any changes will not affect rights that you already have under applicable law.
11.1 Nothing in these terms affects your statutory rights.
